AI Cinema Lab — Terms of Service

Welcome to AI Cinema Lab ("we," "us," "our"), a digital membership platform operated by AI Cinema Lab ("Company") and accessible at aicinemalab.ai. By accessing or using AI Cinema Lab, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.

1. Overview of the Service

AI Cinema Lab is an online educational platform that provides course content, tutorials, tools, and community resources related to AI-assisted cinematic art and motion design. Access to AI Cinema Lab is primarily offered as a one-time purchase. An optional recurring monthly community membership may also be available. The platform is hosted on Kajabi and may integrate with third-party tools and services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use AI Cinema Lab. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@aicinemalab.ai if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Purchases and Billing

4.1 One-Time Purchase. Access to AI Cinema Lab course content is offered as a one-time purchase at the rate published on aicinemalab.ai. Upon completing your purchase, you receive access to the course materials included in your purchase. There is no recurring charge for the core course.

4.2 Optional Monthly Community Membership. AI Cinema Lab may offer an optional recurring monthly community membership as a separate add-on. If you opt into the community membership, you will be billed on a recurring monthly basis beginning on the date you subscribe. You may cancel the community membership at any time through your Kajabi account settings or by contacting us at hello@aicinemalab.ai. Upon cancellation, you will retain community access through the end of your current billing period.

4.3 Payment Processing. All payments are processed through Kajabi's payment infrastructure. You authorize us to charge the payment method on file for your purchase and, if applicable, recurring community membership fees. You are responsible for keeping your payment information current.

4.4 Pricing Changes. Pricing for new purchases is subject to change at any time. Active community membership pricing will not change without 30 days' prior notice to current members.

5. 30-Day Money-Back Guarantee

If you are not satisfied with your purchase, you may request a full refund within 30 days of your initial purchase date by contacting us at hello@aicinemalab.ai. After the 30-day window, all payments are non-refundable. This guarantee applies solely to the one-time course purchase and does not apply to the optional monthly community membership, which is non-refundable.

6. Cancellation

6.1 Course Access. Because the core course is a one-time purchase, there is nothing to cancel. Your access to the course materials you purchased remains available to you subject to these Terms.

6.2 Community Membership. If you have opted into the monthly community membership, you may cancel at any time through your Kajabi account settings or by contacting us at hello@aicinemalab.ai. Upon cancellation, you will retain community access through the end of your current billing period. No partial refunds are issued for the current billing period.

7. Content Ownership and Intellectual Property

7.1 Our Content. All course materials, videos, images, text, graphics, templates, slide decks, voiceovers, and other content provided through AI Cinema Lab ("Platform Content") are the intellectual property of AI Cinema Lab and/or its licensors. Platform Content is protected by copyright, trademark, and other intellectual property laws.

7.2 License to You. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Platform Content solely for your personal, non-commercial educational purposes for as long as your account remains in good standing. You may not reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit any Platform Content without our prior written consent.

7.3 Your Content. You retain ownership of any original content you create using the skills and techniques learned through AI Cinema Lab. However, any content you post or share within the AI Cinema Lab community (forums, comments, submissions) grants us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and promoting the platform.

8. AI-Generated Content and Intellectual Property

8.1 Nature of AI-Generated Works. AI Cinema Lab teaches techniques involving AI image and video generation tools (such as Midjourney, Kling, and similar platforms). The intellectual property status of AI-generated content varies by jurisdiction and is subject to evolving legal standards.

8.2 Your Responsibility. You are solely responsible for understanding and complying with the terms of service of any third-party AI tools you use, as well as applicable intellectual property laws in your jurisdiction. AI Cinema Lab does not guarantee that works created using AI tools will qualify for copyright protection or any other form of IP protection.

8.3 No Legal Advice. Nothing in these Terms or in any course material constitutes legal advice regarding the ownership, copyrightability, or commercial use of AI-generated content. We recommend consulting a qualified attorney for guidance specific to your situation.

9. Acceptable Use

You agree not to:

Share, resell, or redistribute your login credentials or any Platform Content
Record, download, screen-capture, or otherwise copy course materials for redistribution
Use the platform for any unlawful, fraudulent, or harmful purpose
Harass, abuse, or threaten other members or staff
Reverse-engineer, decompile, or attempt to extract the source code of any platform technology
Use automated systems (bots, scrapers) to access or collect content from the platform
Misrepresent your identity or affiliation with any person or entity
Post or transmit any content that is defamatory, obscene, or infringes on the rights of others

Violation of these terms may result in immediate suspension or termination of your account without refund.

10. Digital Millennium Copyright Act (DMCA)

10.1 Respect for Copyright. We respect the intellectual property rights of others and expect our users to do the same.

10.2 Filing a DMCA Takedown Notice. If you believe that content on our platform infringes your copyright, you may submit a written notification to our designated agent at:

Your notice must include: (a) a description of the copyrighted work you claim has been infringed; (b) identification of the infringing material and its location on the platform; (c) your contact information; (d) a statement that you have a good faith belief the use is not authorized; (e) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (f) your physical or electronic signature.

10.3 Counter-Notification. If you believe your content was removed in error, you may file a counter-notification containing the information required under 17 U.S.C. § 512(g).

10.4 Repeat Infringers. We reserve the right to terminate accounts of users who are found to be repeat infringers.

11. Third-Party Services and Links

AI Cinema Lab may reference or integrate with third-party tools and platforms (including but not limited to Midjourney, Kling, Freepik, Higgsfield, ElevenLabs, and others). These third-party services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

12. Disclaimer of Warranties

THE PLATFORM AND ALL PLATFORM CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

WE MAKE NO GUARANTEES REGARDING THE RESULTS OR OUTCOMES YOU MAY ACHIEVE FROM USING THE PLATFORM, INCLUDING BUT NOT LIMITED TO CAREER ADVANCEMENT, INCOME, OR COMMERCIAL SUCCESS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AI CINEMA LAB, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless AI Cinema Lab and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you post or share on the platform.

15. Dispute Resolution

15.1 Informal Resolution. Before filing any formal proceeding, you agree to first contact us at hello@aicinemalab.ai and attempt to resolve the dispute informally for at least 30 days.

15.2 Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.

15.3 Class Action Waiver. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15.4 Exceptions. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

16. Privacy

17. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email or through a notice on the platform at least 30 days before they take effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised Terms.

18. Termination

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform ceases immediately. Sections 7, 8, 12, 13, 14, 15, and 16 shall survive termination.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict of law principles.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the platform, constitute the entire agreement between you and AI Cinema Lab regarding your use of AI Cinema Lab.
